Content

Unauthorized use or destruction of highway land or damage to highway facilities shall be subject to a fine of no less than NTD 60,000 and not more than NTD 300,000; the highway authority shall order the offender to restore the original condition, reimburse the restoration fees, or provide compensation. In the aforementioned circumstances, if a written notice specifying a reasonable period for restoration is given and the party fails to comply by the deadline, the highway authority may impose a fine of no less than NTD 60,000 and no more than NTD 300,000, and may be subjected to fine per occurrence. If piping or wiring agencies or other engineering agencies install pipelines or other public facilities and fail to maintain traffic or conduct repairs as stipulated in the applied-for and permitted engineering project plan, the agencies shall be fined at least NTD 30,000 but not more than NTD 150,000, and shall be requested to improve in a given period. If the required improvements are not made by the specified deadline, agencies shall be subjected to fine per occurrence. Where piping or wiring agencies or other engineering authorities (agencies) use highway land to install pipelines, manholes, or handhole covers, they shall restore and properly backfill the area after installation or maintenance to be flush with the adjacent road surface. The anti-skid value standards for surface facilities such as manhole or handhole covers shall not be lower than the standards set by the MOTC. Furthermore, within the warranty period after backfilling as determined by the highway authority, the road surface smoothness shall be tested using a three-meter straightedge, and the single-point elevation difference shall not exceed ±0.6 cm. Violators shall make improvements within a specified time limit; if improvements are not made by the deadline, they shall be subject to a fine of no less than NTD 30,000 and no more than NTD 150,000, and shall be ordered to improve within a specified time limit; if improvements are still not made by the deadline, they shall be subjected to fine per occurrence. When necessary for maintenance, the highway authority may request piping or wiring agencies or other engineering authorities (agencies) to place certain manhole or handhole covers underground. However, if the piping or wiring agencies or other engineering authorities (agencies) have disaster relief or special needs, they may be exempted. The scope of special needs shall be determined by the MOTC in consultation with municipal, county (city) governments, and relevant piping or wiring agencies. If pipelines or other facilities installed by piping or wiring agencies or other engineering authorities (agencies) cause damage to people’s lives, bodies, or property due to defects in installation or management, or if the competent authority discovers through inspection that the road surface restoration is improper or poses a risk of injury, improvements shall be made within a specified time limit. If improvements are not made by the deadline, they shall be subject to a fine of no less than NTD 30,000 and no more than NTD 150,000, and shall be ordered to improve within a limit; if improvements are still not made by the deadline, they shall be subject to fine per occurrence. The scope of installation for pipelines or other facilities mentioned in the preceding paragraph refers to the area excavated for construction within the highway land. Violations of the provisions of Paragraph 1 and Paragraphs 3 to 6 that result in a major disaster shall be subject to a fine of no less than NTD 150,000 and no more than NTD 1,500,000. Unauthorized construction on proposed highway land after promulgation and boundary marking and forbidding or restricting construction shall be demolished by highway authorities in joint with relevant authorities.
