A person who has any of the following behaviors in an attempt to evade educational mobilization or duty mobilization shall be sentenced to imprisonment for not more than three (3) years: 1. Fabricating the reasons for an exemption from military service, discharge from military service, military category transfer, or exemption from recall. 2. Self-harm or self-mutilation. 3. Refusing to accept a recall order notice. 4. Having been recalled to service but two (2) days have past the specified deadline for reporting to service without any excuse. 5. Having someone else to report to recall in his place. A person who fails to participate in a muster recall without any excuse or attempts to evade roll-call mobilization and has any of the behaviors specified in Subparagraph 1 ~ 3 or 5 shall be sentenced to imprisonment for not more than one year, detention, or commutation to a fine of not more than NT$90,000.
意圖避免教育召集或勤務召集，而有下列行為之一者，處三年以下有期徒刑： 一、捏造免役、除役、轉役或免除召集原因。 二、毀傷身體。 三、拒絕接受召集令。 四、應受召集，無故逾應召期限二日。 五、使人頂替本人應召。 無故不參加點閱召集，或意圖避免點閱召集，而有前項第一款至第三款及第五款行為之一者，處一年以下有期徒刑、拘役或科新臺幣九萬元以下罰金。
