La Regla General 2 del Arancel Aduanero de Importación divide las tasas en 3 columnas: la primera columna se aplica a las mercancías importadas de miembros de la Organización Mundial del Comercio, o de países o territorios con trato recíproco hacia Taiwán; la segunda columna solo se aplica a mercancías “específicas” en dos supuestos: productos específicos de países o territorios menos desarrollados o en desarrollo, o productos específicos de países o territorios con los que Taiwán ha firmado un acuerdo de libre comercio o de cooperación económica; cuando no se puede aplicar ninguna de las dos columnas anteriores, se aplica la tercera columna. Cuando pueden aplicarse a la vez la primera y la segunda columna, se toma la tasa más baja. China continental es miembro de la Organización Mundial del Comercio, por lo que en principio se le aplica la primera columna; la segunda columna solo se aplica a China continental para las mercancías de la lista de cosecha temprana del ECFA.
Las páginas de capítulos y líneas arancelarias de este sitio muestran la tasa de la primera columna. En la tabla del arancel, la segunda columna se marca con códigos de país para indicar a quién se aplica, por ejemplo “exento (PA,GT,NI,SV,HN,NZ,SG)”; los códigos son solo una indicación en la tabla arancelaria, y algunos de esos acuerdos ya han dejado de aplicarse o han terminado (como Nicaragua, El Salvador y Honduras); la aplicación real se rige por los avisos de la Administración de Aduanas. Los artículos sueltos de paquetes postales tienen una regla aparte: cuando el valor tributable supera el límite de exención, se cobra un arancel del 5%, salvo el tabaco, el alcohol y los artículos sujetos a contingente arancelario; pero si el total de un mismo artículo o de la misma línea arancelaria supera los NT$2.000, no se considera artículo suelto y se cobra según la tasa de cada línea arancelaria (Regla General 5; artículos 8 y 9 del Reglamento de Despacho Aduanero de Importación y Exportación de Paquetes Postales). Esta tasa del 5% solo se aplica a paquetes postales y a pasajeros; las mercancías de envío exprés se calculan según la tasa de cada línea arancelaria.
Preguntas frecuentes
¿Qué impuestos hay que pagar al importar a Taiwán productos del Capítulo 55?
Por lo general hay tres cargos:
- Arancel: en las líneas de arancel ad valorem es el valor tributable × la tasa; en las líneas de arancel específico se calcula por cantidad o por peso (las importaciones procedentes de China continental se rigen, en principio, por la primera columna).
- IVA: la base imponible es el monto resultante de sumar el arancel al valor tributable, y lo recauda la Aduana en nombre del fisco (artículos 20 y 41 de la Ley del IVA sobre Operaciones con y sin Valor Añadido); en los productos también sujetos al impuesto sobre mercancías o al impuesto sobre tabaco y alcohol, la base imponible se incrementa aún más.
- Tasa de promoción del comercio: el límite legal es del 4,25 por diez mil del valor de la mercancía (artículo 21 de la Ley de Comercio Exterior); actualmente se cobra el 4 por diez mil del valor tributable, y se exime cuando el monto a pagar no supera los NT$100.
¿Hay un umbral de exención de impuestos para las importaciones de pequeño monto? ¿Cómo se cobra si se supera?
Sí. Cuando el valor tributable de las mercancías importadas en el mismo lote es de NT$2.000 o menos, están exentas del arancel y del IVA e impuesto sobre mercancías recaudados por la Aduana, salvo el tabaco, el alcohol y los productos agrícolas sujetos a contingente arancelario (aviso del Ministerio de Finanzas Tai-Cai-Guan-Zi n.º 1061018778, de 7 de septiembre del año 106 de la República de China [2017]; para paquetes postales, véase además el artículo 7 del Reglamento de Despacho Aduanero de Importación y Exportación de Paquetes Postales). Hay que tener en cuenta tres cosas:
- Si un mismo contribuyente supera 6 despachos exentos de impuestos dentro de un mismo semestre (enero–junio o julio–diciembre), las importaciones posteriores de ese período ya no están exentas (orden del Ministerio de Finanzas Tai-Cai-Guan-Zi n.º 1061011007, de 26 de mayo del año 106 de la República de China [2017]).
- Las mercancías de envío exprés del mismo lote no pueden dividirse para declararlas por separado (artículo 14 del Reglamento de Despacho Aduanero de Mercancías de Envío Exprés por Vía Aérea).
- Cuando un paquete postal supera el límite, se grava la totalidad, no solo la parte que excede (artículo 8 del Reglamento de Despacho Aduanero de Importación y Exportación de Paquetes Postales).
¿Cuántas líneas arancelarias del Capítulo 55 tienen un arancel del 0%?
De las 147 líneas arancelarias de este capítulo, 0 tienen una tasa del 0% en la primera columna, es decir, el 0%. El 0% solo significa que el arancel es cero: al importar, en principio aún hay que calcular el IVA (el umbral de exención para pequeño monto se explica en la pregunta anterior), y la normativa de importación de la línea arancelaria (inspección, cuarentena, documentos de permiso) tampoco queda exenta por ello.
¿Se pueden enviar a Taiwán desde China continental productos del Capítulo 55?
Hay que confirmarlo línea por línea. Este capítulo tiene 112 líneas arancelarias con el código MW0 (mercancías de China continental cuya importación no está permitida), pero MW0 no significa que esté prohibido enviarlas en todos los casos. MW0 = importación desde China continental prohibida. Excepción: las mercancías de China continental de los capítulos 25–97 importadas en pequeñas cantidades no necesitan permiso de importación si toda la declaración no supera un CIF de NT$32.000 y cada producto no pasa de 24 unidades (40 kg si no se puede contar; cada producto se identifica por su modelo y, si no tiene modelo, por cada línea de la declaración, sin poder dividirse por tamaño, especificación o color; la piedra de la partida 6802 y las baldosas de la partida 6907 deben cumplir a la vez 24 unidades y 40 kg). Quedan excluidas las motocicletas eléctricas, las bicicletas eléctricas y sus controladores (partidas 8711.60.10, 8711.60.20 y 8543.70.99.50), y los capítulos 1–24 no se benefician. Los demás requisitos de importación, como inspección y cuarentena, deben cumplirse por separado. Esto no significa que estén exentas de impuestos.Además, 6 líneas arancelarias tienen el código MP1 (mercancías de China continental permitidas con condiciones), que deben cumplir lo dispuesto en la Lista de Artículos de Importación Condicionalmente Permitida y Normativa de Gestión de Importación de Mercancías de China Continental de la Administración de Comercio Internacional.
Dentro de un mismo capítulo, ¿cómo sé a qué línea arancelaria pertenece mi producto?
Según las Reglas Generales de Interpretación del Arancel Aduanero de Importación, los títulos de las secciones y capítulos solo sirven de referencia; la clasificación se basa en el texto de la línea arancelaria y en las notas de sección y de capítulo (Regla 1); cuando el texto de la línea y las notas no lo determinan, se aplican, en orden, el tratamiento de los artículos incompletos y las mezclas (Regla 2), la preferencia por la descripción más específica, la característica esencial y la clasificación por la partida que aparezca en último lugar (Regla 3), la mayor semejanza (Regla 4), con reglas propias para envases y embalajes (Regla 5); al bajar al nivel de “ítem”, la Regla 6 solo permite comparar ítems del mismo nivel. Si aun así queda alguna duda, el contribuyente o su representante puede solicitar a la Aduana, antes de importar la mercancía, una clasificación arancelaria previa, que la Aduana responde por escrito (artículo 21 de la Ley Aduanera); si la mercancía llegada coincide con la de la solicitud previa, la Aduana debe aplicar la línea arancelaria previamente determinada, salvo que el solicitante haya proporcionado datos erróneos o falsos (artículo 10 del Reglamento de Aplicación de la Clasificación Arancelaria Previa de Mercancías Importadas).
¿De dónde vienen las fuentes legales y los datos de esta página?
- Artículo 3 de la Ley Aduanera: salvo disposición distinta de la Ley Aduanera, la recaudación de aranceles y la clasificación arancelaria de las mercancías de importación y exportación se rigen por el Arancel Aduanero de Importación; el Arancel Aduanero de Importación se promulga mediante un procedimiento legislativo independiente.
